Following a physical altercation and robbery,Respondent,Anthony Ablonczy, was arrested and charged with armed robbery, robbery, first and second degree assault, and theft of less than one thousand dollars.Prior to the commencement of a jury trial inthe Circuit Court for WashingtonCounty, defensecounselforRespondentsubmitted severalvoir direquestions to be posed to the venire, including a proposed question which addressed the presumption of innocence, burden of proof beyond a reasonable doubt, and the right to remain silent.The trial courtdeclined to pose the question, defensecounselobjected, the objection was overruled, andvoir direresumed.
